By using the Services, you agree to these Terms. If you do not agree to these Terms, you should not place an order on our website. These terms and conditions contain binding arbitration clauses, class action waivers, and jury trial waivers that affect your rights in how your dispute is resolved.   • 3.2: While we take reasonable steps to ensure accuracy, all product dimensions and measurements detailed on our website are approximate. We cannot guarantee that all details are always accurate, complete or error-free.
  • 3.3: The sale of all our products is restricted to domestic and private use. Therefore, none of our products are used for any commercial purpose.

4 Product availability

This may occur in the following circumstances, including (but not limited to) when the product is out of stock, due to an unexpected limitation of resources that we cannot reasonably plan for, or because we discover an error in the product. 6. How is the contract between you and us concluded

  • 6.1: Once you place your order, you should receive an email from us confirming that we have received your order (but if you have not received this email, please contact us). Please note that this does not mean that your order has been accepted or that a contract has been entered into between you and us. All orders are subject to our availability and acceptance (which we may decline for any reason).
  • 6.2: Immediately after you submit your order, we contact your bank or card issuer to obtain authorization to collect payment from your account. We will not process your order until full payment is received. If we accept your order, we will confirm this by sending you a further email (the “shipping confirmation”) confirming that the product is being processed and ready to ship, at which time a contract between you and us (the “Contract”) will take effect and be formed.
  • 6.3: We begin processing your order as soon as you place it, which means that you will not be able to change your order prior to delivery, but you may return the product in accordance with our return policy
  • 6.4: We may make minor changes to the product from time to time to reflect changes in relevant legal and regulatory requirements. If these changes change the product description or other mandatory information provided to you under applicable law, we will update our website.
  • 6.5: These Terms and conditions and any contract between us will be in English only. Please note that we may not necessarily keep a copy of your contract. You should keep copies of these terms and conditions as well as your order for future reference.

7. Deliver

  • 7.1: We will endeavour to fulfill your order before the delivery date specified in the shipping confirmation, or, if no delivery date is specified, as soon as possible (depending on the delivery service you choose). In any event, delivery will take place within 30 days of the date of the contract.
  • 7.2: If there is no one available to pick up at your address, and the product cannot be delivered through your mailbox or left in a safe place and/or if you do not pick up the product from the address notified to you by our carrier within the specified time limit notified to you by our carrier when attempting delivery, we may terminate the contract and Clause 10 will apply.
  • 7.3: The delivery of your order will be complete when we ship the product to the address you have provided to us, and the product will be your responsibility from then on.
  • 7.4: Your order may be delivered by different distribution centers. This means that when you place your order, your order may be shipped at different times and may be split into multiple packages. If this is the case, you will see shipping information on the checkout page, as well as in your confirmation email after you place your order. The checkout page will confirm which distribution center each item was shipped from and confirm when you can expect to receive it.
  • 7.5: If the item is shipped from another warehouse, read your shipping options carefully at checkout, as some shipping options may not be available. For multiple shipments, you do not have to pay additional shipping, duties or taxes.
  • 7.6: If you checkout using bank details, Paypal or Apple Pay, you will have the product after we receive payment in full. However, when you check out using an installment payment method, such as through a financial provider such as Klarna, then the alternative terms will apply to you, see section 8 below for more information on this.
  • 7.7: Please be aware of zip code and/or zip code restrictions. Delivery times and costs may increase if the product is shipped outside the United States. Check your eligibility here.
  • 7.8: In addition, if you order a product from us for shipping to a destination outside the United States:
    • (a) Your order may be subject to import duties and taxes, which are levied upon arrival at the destination of delivery. Please note that we have no control over these fees and cannot predict their amount. You will be responsible for paying any such import duties and taxes. Contact your local customs office for more information before placing your order. We will not be liable if you do not pay any such import duties or taxes;

8. Price and payment

  • 8.1: The price payable for the product should be in US dollars (USD) as shown on our website, but if we find an error in the price of any product you ordered, please see Clause 8.7 below to find out what will happen.
  • 8.2: If you view our website from the United Kingdom or an EU country, the product prices advertised on our website for products located in the European Union include UK VAT at the relevant rate currently levied. Additional delivery charges (including the UK VAT we charge) will vary depending on the product you ordered and the delivery address, and will be shown separately during the checkout process.
  • 8.3: We reserve the right to change our website prices at any time without notice, but the changes will not affect orders we have already accepted. However, if applicable and the VAT rate changes after the date of your order, we will adjust the VAT rate you pay, unless you have paid for the product in full before the VAT change takes effect.
  • 8.4: The taxes shown on your online order confirmation are estimated taxes. Because the order may be fulfilled at multiple locations in the United States, the actual taxes charged to your credit card will be calculated based on the applicable state and local sales taxes at the time your order is shipped. We do not charge sales or use taxes in all states. For states with a sales or use tax, your purchase may be subject to use tax unless it is explicitly exempt.   • 8.6: You must pay for the product (including all applicable shipping charges), and once you reach the final billing page and submit your order, we will charge you from the card you selected to pay for your order. We contact your bank or card issuer immediately to obtain authorization to collect the payment from your account. If you use any third party service provider to make payments, such payments are subject to the third party service provider’s terms and conditions.
  • 8.7: Despite our best efforts, there is a possibility that some of the products we sell may be incorrectly priced. If we find that pricing is incorrect, we reserve the right to refuse the order. We will usually check the price before accepting your order, and if the price is incorrect, we will attempt to contact you for instructions before accepting your order. If we are unable to contact you, your order will be cancelled. If we accept and process your order, but there is a clear and unmistakable pricing error, and you may reasonably believe that this was a pricing error, we may terminate the contract, refund any money you paid under the contract, and request the return of any products provided to you.
  • 8.8: If you wish to apply a discount code or e-voucher code to your order, you must enter the relevant code during the online checkout process. Only one discount code and/or up to five e-voucher codes can be used per order, and additional terms and conditions may apply to each discount code. We reserve the right to decline to accept any discount or e-voucher code that is invalid or has expired for your order.

10. Our right to cancel the contract

    • (b) you do not provide us with the information we need to supply our products within a reasonable time required by us; or
    • (c) You fail to allow us to deliver the Product to you within a reasonable time, or you are unable to receive the delivered Product.
    • (d) if the product you ordered is no longer available.
  • 10.2: We may also terminate the contract in the circumstances set out in Clause 8.7.
  • 10.3: If we terminate the contract in any of the circumstances set out in Clause 10.1 or 10.2, we will refund any money you paid in advance for a product we did not supply, but we may deduct or charge you a reasonable compensation fee that will be incurred as a result of your breach of contract.

11. Inaccurate, incorrect or damaged products

  • 11.1: We attempt to describe the products displayed on our website as accurately as possible. We cannot guarantee that all details are always accurate, complete or error-free. If you believe that the product description is inaccurate or that your product has been damaged, please initiate a refund as set out in our Refund Policy.

12. Our responsibilities

You further agree that you will not export, re-export, or otherwise transfer products to countries or territories targeted by comprehensive embargoes or sanctions, or to parties designated on the U.S. Department of the Treasury’s list of specially designated Nationals and Blocked persons. We do accept any liability to you for any loss of profits, loss of business, interruption of business or loss of business opportunity, any indirect or consequential loss or damage, and will not invoice you for VAT on your purchases. Beyond our reasonable control, including, in particular, (but not limited to) :
    • (a) strikes, lockouts or other industrial actions.
    • (b) an epidemic or pandemic or governmental action resulting from such an epidemic or pandemic.
    • (c) civil disturbances, disturbances, invasions, terrorist attacks or threats of terrorist attacks, war (whether declared or not) or threats of war or preparations for war.
    • (d) fire, explosion, storm, flood, earthquake, sinkhole, epidemic, epidemic, or other natural disaster.
    • (e) Lack of access to rail, sea, air, motor transport or other means of public or private transportation.
    • (f) Lack of access to public or private telecommunications networks.
    • (g) any governmental decree, decree, legislation, regulation or restriction.

16. Promotional Terms and Conditions

  • 16.1: The ELTE Official promo code enables you to take advantage of the offer on online orders at eltecommerce.com. To use the promo code, click the “Redeem promo Code” button on the order summary page, then enter the specific code. Note that promo codes can only be used once per transaction and cannot be used in conjunction with any other promotion or offer. Promo codes are region-specific, our property, non-transferable, and may not be used to purchase gift cards or gift certificates. There is no cash alternative. Promo codes and associated offers are not available to ELTE employees, and we reserve the right to withdraw and decline or limit any order at any time. Promo codes are only valid for payments made on eltecommerce.com by U.S. residents.

17. Other important Terms

  • 17.1: If we must contact you, we will contact you in writing or by telephone using the contact details you have provided to us in your order, unless you have asked us to contact you by any other means.   • 17.5: Each paragraph of these Terms and conditions operates separately. If any of these paragraphs is determined by any court or relevant authority having jurisdiction to be unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
  • 17.6: If we fail to insist that you perform any of our obligations under these Terms and conditions, or if we fail to enforce our rights against you, or if we delay in doing so, it does not mean that we waive our rights against you and you do not have to comply with those obligations. If we do waive your breach, we will only do so in writing and it does not mean that we will automatically waive any future breach by you.
